    Permanent Residence – Section 27 (Residency on Other Grounds)

Under Section 27 of the Immigration Act, an individual may qualify for permanent residence on special grounds other than long-term residence. These categories typically apply to individuals who contribute significantly to South Africa’s economy, possess critical skills, or have other specific qualifying circumstances.

Permanent Residence Based on Work

This applies to individuals who have held a valid work visa for at least five consecutive years, and whose employment has been offered on a permanent basis.

Requirements include:

Proof of five years of continuous work in South Africa.

A permanent job offer from a South African employer.

A favourable recommendation from the Department of Labour.

Permanent Residence Based on Exceptional Skills or Qualifications

This applies to individuals who possess exceptional skills or qualifications that are deemed to be of benefit to South Africa.

Applicants must show:

Recognised exceptional skills or academic qualifications.

Letters of recommendation or proof of expertise.

Evidence of achievements in their field.

Permanent Residence Based on Business

This category is for foreign nationals who have invested a prescribed financial amount in an existing or new business in South Africa.

Requirements include:

Minimum capital investment (as determined by the Department of Home Affairs).

Proof that at least 60% of employees are South African citizens or permanent residents.

A business plan and registration documents.

Permanent Residence Based on Refugee Status

A recognised refugee who has held refugee status for at least five years may apply for permanent residence under this category.

Requirements:

Proof of continuous refugee status for five years.

Certification from the Standing Committee for Refugee Affairs (SCRA) confirming the individual’s eligibility.

Permanent Residence Based on Relatives

This applies to immediate family members of South African citizens or permanent residents.

Qualifying relationships include:

A spouse (married or life partner) of a South African citizen or permanent resident.

A child of a South African citizen or permanent resident.

parent of a South African citizen or permanent resident.
Note: Proof of relationship and financial dependency may be required.

Permanent Residence on Other Grounds

This is a discretionary category allowing the Minister of Home Affairs to grant permanent residence to a person who does not fall under the above categories but has special circumstances that warrant approval.

Example include:

Long-term contribution to South Africa’s interests.

Exceptional humanitarian or compassionate grounds.
