A Spousal Visa allows the foreign spouse or life partner of a South African citizen or permanent resident to reside legally in South Africa based on their relationship. This visa is typically issued for up to two years and may be renewed as long as the relationship remains valid and genuine. Applicants must provide proof of a legitimate marriage or permanent partnership, shared financial responsibility, and cohabitation. After five years on a spousal visa, the foreign partner may qualify to apply for permanent residence.

The Spousal Visa is intended for foreign nationals who are legally married to a South African citizen or permanent resident. This visa allows the foreign spouse to live in South Africa for the duration of the relationship and, where applicable, to apply for permission to work or study


It promotes family unity by enabling couples to reside together lawfully in South Africa.

The Spousal Visa is generally issued for a period of up to two years and may be renewed while the relationship remains valid and supported by evidence of marriage and cohabitation.

A valid marriage certificate must be provided as proof of the relationship.

The South African spouse or permanent resident must provide proof of financial means to support the foreign spouse.

Applicants must demonstrate that the marriage is genuine and ongoing.

The foreign spouse may apply for endorsement to work, study, or conduct business once the spousal visa has been issued.

The visa is linked to the existence of the marriage; if the relationship ends, the visa may be withdrawn or not renewed.

Holders cannot engage in work or study unless specifically endorsed to do so.

The visa cannot be used as a pathway to permanent residence without meeting the prescribed residence period (usually five years).

The visa remains valid for the approved duration, typically two years, and is renewable as long as the marriage continues and all requirements are met.

Renewal applications must be submitted at least 60 days before expiry with updated supporting documents (proof of cohabitation, financial means, and marriage).

After five years of continuous residence on a valid spousal visa, the foreign spouse may apply for permanent residence under Section 26(b) of the Immigration Act.
