A Work Visa allows foreign nationals to live and work legally in South Africa under specific employment conditions. It is designed to attract skilled professionals who can contribute to the country’s economy and fill roles where local expertise may be limited. There are various types of work visas — including General Work, Critical Skills, and Intra-Company Transfer visas — each with distinct requirements. Applicants must typically provide proof of employment, qualifications, and, in some cases, Department of Labour certification. Work visas are usually issued for the duration of the employment contract and can be renewed or lead to permanent residence.

The Work Visa allows foreign nationals to live and work legally in South Africa for a specified employer or under specific employment conditions.

It aims to attract individuals with the skills, qualifications, or experience that are needed in the South African labour market.

There are several types of work visas under the Immigration Act:

General Work Visa: For individuals with a confirmed job offer and a completed labour market test (proof that no suitable South African could fill the position).

Critical Skills Work Visa: For individuals possessing qualifications or expertise listed on South Africa’s Critical Skills List.

Intra-Company Transfer Visa: For employees transferring from a foreign branch or subsidiary of a company to its South African branch.

Corporate Visa: Issued to companies to employ a predetermined number of foreign workers under approved conditions.

General Work and Critical Skills Visas: Typically valid for up to five years, depending on the employment contract and supporting documents.

      Intra-Company Transfer Visa: Usually valid for up to four years, non-renewable.

      Corporate Visa: Valid for the period approved for the specific employer.

       Applicants must hold a valid job offer or demonstrate employment under the relevant category.  

 All qualifications must be evaluated by SAQA (South African Qualifications Authority).

       The employer must comply with Department of Labour certification requirements.

       The visa holder must work only for the employer and position specified in their visa.

       Applicants and employers must comply with all provisions of the Immigration Act and Employment Services Act.

      The visa holder may not change employers or positions  without first applying for a new visa.

      Work visas cannot be converted to another category (e.g., spousal or business visa) from within South Africa, unless allowed by regulation.

    Overstaying or working outside the conditions of the visa may lead to fines, visa cancellation, or being declared undesirable.

    The Work Visa remains valid for the period indicated on the visa, usually aligned with the employment contract.

      Renewal applications must be submitted at least 60 days before expiry, accompanied by updated employment confirmation, contract, and proof of continued compliance.

    After five years of continuous residence on a work visa, the holder may qualify to apply for permanent residence under Section 26(a) of the Immigration Act.
